Orange man sues after doors couldn't stand the weather

Orange County resident David Hinds has filed a deceptive trade practices lawsuit against Parker Lumber and Jeld-Wen Inc. He claims the $20,000 weather resistant doors he purchased rotted.

Hinds' suit was filed with the Orange County District Court on Sept. 25.

According to the plaintiff's original petition, Hinds purchased exterior doors from the defendants for his home.

The suit does not say when he purchased the doors, but does say, "Defendants represented that the doors would be of the best quality and be able to withstand the weather conditions of Orange, Texas."

Orange has been hit with two hurricanes in two years.

In his suit, Hinds says he spent $20,000 for the failing doors.

"The doors deteriorated and rotted, requiring repair and replacement…," the suit said, adding that the door draperies also had to be replaced.

The suit alleges the defendants violated the Deceptive Trade Practices Act. "Defendants' conduct was committed knowingly…"

The suit further faults the defendants with breach of express warranty, breach of implied warranty and breach of warranty merchantability.

Hinds is suing for $60,000 in actual damages, plus all court costs.

He is represented by attorney Clay Dugas.

The case has been assigned to the 260th Judicial District.
