Janitor files wrongful termination suit against school district

TEXARKANA - Custodial crew leader, Narcisco (Cecil) Ortega, Jr., believes he was terminated from his job as retaliation for filing a discrimination charge against his employer, Frisco Independent School District.

The North Texas resident filed the wrongful termination suit against Frisco Independent School District on Nov. 13 in the Texarkana Division of the Eastern District of Texas.

Employed by the school district for more than 12 years, Ortega's supervisor fired him on Sept. 26, 2007. According to Ortega, his supervisor said, "They could not work with him."

The discharge decision came three weeks after Ortega filed a discrimination charge with the U.S. Equal Employment Commission.

Ortega is seeking an award for back pay, employment benefits, interest on back pay, future economic benefits, pecuniary losses, emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life, prejudgment interest, and attorney fees.

The school district has not responded to the charges.

Requesting a trial by jury, representing the plaintiff is attorney,

Wade A. Forsman of Sulphur Springs.

U.S. District Judge David Folsom is assigned to the case.
