Memorial Hermann sued for resuscitating man's father

An Orange man has filed a wrongful death suit against the nursing home he claims allowed his father to develop pneumonia and the hospital that ignored an order that he not be resuscitated.

Representing the estate of Willie Patin, Ray Patin filed suit against Memorial Hermann Baptist Orange Hospital and Oakwood Manor Nursing Home in the Orange County District Court on Dec. 20.

According to the plaintiff's petition, Willie Patin was kept in a "sedentary" position while admitted to Oakwood Manor.

He then "developed bed sores and staph infection, which ultimately resulted in his pneumonia-related death in January 2007," the suit said.

When Patin became ill, Oakwood Manor transported him to Memorial Hermann Baptist Orange Hospital but "negligently failed to notify any member of Mr. Patin's family of his hospitalization for over 24 hours," the suit said.

Ray Patin had placed a "do not resuscitate order" on Willie Patin, the suit said. However, "Hermann Baptist failed to comply with the (order). As a result of Hermann Baptist's negligence, Mr. Patin was forced to suffer additional pain, anguish and expense prior to his death."

Ray Patin is suing for exemplary damages, plus medical expenses, mental anguish, pain and loss of consortium.

He is demanding a trial by jury and is represented by John R. Dolezal.

The case has been assigned to the 260th Judicial District, Judge Buddy Hahn presiding.
