Process server sues over dog bite

Bitten by a dog while serving a legal notice, Andrea Jones has decided to bite back and sue.

Jones filed her suit against the dog's owner John Bergeron and his wife in the Jefferson County Court at Law No. 1 on March 13.

According to Jones' petition, on April 12, 2007, she was working as a process server and was delivering "some legal papers to Bergeron" at his residence when the dog came bursting through the backyard and latched on to Jones' leg.

"While (Jones) was standing in front of the house, a dog owned by the defendants came around the house from the back and leaped on … her and bit her on the left leg," the suit said.

The suit claims that "Jones yelled to Mrs. Bergeron that the dog had bit her and Mrs. Bergeron replied, 'It serves you right for coming to our house to serve papers.'"

The suit goes on to say the dog was called back only to be unleashed again. Jones fled while Mrs. Bergeron yelled, "Get off my property," the plaintiff claims.

Jones is alleging the Bergerons negligently failed to control their dog and warn her.

"The plaintiff will show … that as a result of being bitten and terrified by the dog, plaintiff has been caused to suffer extreme physical pain, mental anguish and loss of earnings," the suit said.

Jones is represented by the Law Offices of Woodson E. Dryden.

Judge Alfred Gerson will preside over the case.
