Action Construction files suit to collect $400K in invoices

Years after hammering out a pair of construction contracts, Action Construction has filed suit against Compro Tax Inc. in hopes of collecting more than $400,000 in unpaid invoices.

The suit was filed on May 5 in the Jefferson County District Court.

According to Action Construction's suit, the companies entered into two written contracts on May 9, 2006, and Aug. 2, 2006, for the construction of pouring a concrete slab and erecting a metal building on Compro Tax's property.

"Plaintiff was performing its contractual obligations and Defendant breached by failing to tender payment upon demand," the suit said.

"Defendant's breach caused injury to Plaintiff including an overdue unpaid balance of $437,998.00, court costs and attorney's fees. Plaintiff seeks unliquidated damages within the jurisdictional limits of this court."

Compro's property is located at 4810 & 4830 Romeda Road in Beaumont. The two contracts totaled $2,743,449.00. And after construction was well underway, Compro began changing the details of the plans, the suit says.

"Plaintiff tried to no avail to accommodate Defendant," the suit said. "Defendant failed and refused to pay Plaintiff and other obligations agreed upon in The Contract enabling Plaintiff to complete the project."

The suit accuses the defendant of breaching its contract and quantum meruit.

Action Construction is represented by attorney Brett Thomas of the Roebuck & Thomas law firm.

The case has been assigned to Judge Donald Floyd, 172nd Judicial District.
