This Just In: Recent civil suits filed in Jefferson County District Courts

May 19
David G. Standley vs. Triple Brothers LTD et al
PA - Lindsey Whisenhant, J - Milton Shuffield
Standley has filed suit against Triple Brothers and one of its truck drivers, James Sparks. On Aug. 4, 2006, the plaintiff was traveling in his Ford truck when Sparks, driving a tractor trailer, rear-ended him while traveling at an unsafe speed.
The suit states the defendants were negligent for allegedly failing to control their speed, maintain a proper lookout and apply their brakes in a timely manner. The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

Linda Sistrunk vs. Howard Dedicated Operations Inc. et al
PA - Paul Ferguson, J - Bob Wortham
Sistrunk claims she was hit by an 18-wheller driven by a HDC employee, Vincent Chapman. She is suing both and seeking damages for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

Tina Byrd vs. Guy Giesecke
PA - Dan Ducote, J - Milton Shuffield
On Aug. 20, 2007, Giesecke allegedly negligently failed to control his rate of speed and hit Byrd.
The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

Lori White vs. Normandy Townhomes
PA - Shane Kadlec, J - Milton Shuffield
While empting a bucket that had been collecting leaking water permeating through her roof, a former Hamlet Townhomes tenant says her ceiling caved in and collapsed on her - leaving her forever impaired. The incident happened nearly two years ago, and now Lori While claims she put Normandy Townhomes on notice that her apartment's roof was leaking.
White filed suit against the property management company and is seeking past and future mental anguish, impairment and medical expenses.

Joyce Viator vs. Christus Health Southeast Texas
PA - Kenneth Lewis, J - Gary Sanderson
The suit alleges Christus Hospital St. Mary negligently failed to put fall precautions in place for a seizure patient. Joyce Viator was being treated at St. Mary on Aug. 31, 2006, for a seizure disorder when she fell and broke her hip.
She is suing for exemplary damages.

RLC Supply vs. Tracker Systems
PA - Chris Portner, J - Bob Wortham
After negotiating the contract for the purchase of an inventory tracking system, RLC Supply says Tracker Systems reneged on the deal and yanked the carpet from underneath its feet, leaving the company empty handed.
Seeking actual and consequential damages, RLC filed a breach of contract suit against TS.

Donna Rea Gros vs. Floyd's Cajun Seafood & Texas Steakhouse
PA - Jeffrey Chilton, J - Donald Floyd
A restaurant employee is suing her employer under a legal doctrine which holds places of business liable for their employees' conduct.
Last month, Donna Gros slipped and fell and broke her hip while working as a waitress at Floyd's Cajun Seafood & Texas Steakhouse in Beaumont.
Gros is suing for exemplary a damages, claiming the restaurant acted with malice. She is also suing for past and future pain, mental anguish, medical expenses, impairment, disfigurement and lost wages, plus all court costs.

David Stephens vs. TBRS Inc. et al
PA - Jack Ivey, J - Gary Sanderson
Probably not destined to become a circus tight-rope walker, a TBRS Inc. employee was strolling across a 10-foot wall when it suddenly started to shake, causing him to inadvertently perform his best Humpty Dumpty impression. David Stephens filed suit against his employer and Burleson Plumbing claiming the defendants negligently failed to keep him safe.
Stephens is suing for past and future mental anguish, impairment, disfigurement, medical expenses and lost wages, plus all court costs.

Jeremy Pelican vs. Mike Smith Autoplex et al
PA - Lindsay Barrett, J - Donald Floyd
Seeking around $75,000 for a truck he totaled, Jeremy Pelican has filed suit against the companies who sold, financed and insured his vehicle.
The defendants named in the suit are Mike Smith Autoplex Dodge, CitiFinancial, Southwest Business Corp. and StoneBridge Casualty.

Christine Lemonis vs. H.E. Butt Grocery Co.
PA - Travis McCall, J - Bob Wortham
There may be a new cleaning cycle for hair products: wash, rinse and slip. Christine Lemonis claims she slipped and fell in a puddle of spilled shampoo while shopping at an H-E-B Grocery store.
She is suing for past and future mental anguish, medical expenses, impairment and loss of enjoyment of life.

Audrey Moten et al vs. Four J's Community Living Center Inc.
PA - Tommy Yeates, J - Gary Sanderson
A band of former retirement home employees are claiming they were discriminated against after cooperating with an Adult Protection Services investigation. Apparently, the state of Texas shut down Four J's Community Living Center following the investigation.
Audrey Molten, Mary Langley, Linda Guillory, Latasha Smith and Doris Hickerson filed suit against Four J's Community Living Center, alleging "that they were terminated or otherwise discriminated against because of their cooperation with APS."
The plaintiffs are suing for past and future mental anguish and lost wages.
