Jones Act suit filed against Kirby Inland Marine

Merchant mariner John R. McGee has filed a lawsuit against Kirby Inland Marine for injuries he received more than two years ago while working aboard one of the firm's ships.

McGee's lawsuit was filed July 9 in Jefferson County District Court.

The lawsuit claims McGee was injured June 30, 2006, while working for Houston-based Kirby as a tankerman aboard the vessel Creole Dee.

The lawsuit filed under the Jones Act gives no specifics on McGee's alleged injury, and says only that "defendant was negligent and the vessel was unseaworthy."

"On said date as a result of said occurrence, plaintiff sustained severe and painful injuries to his left shoulder, among other parts of his body," the suit says.

"Such occurrence and such injuries occurred as a proximate result of the unsafe and unseaworthy condition of the Creole Dee, its crew and appurtenances and/or equipment or, in whole or in part, as a proximate result of the initial acts and/or negligence or lack of attention on the part of defendants…"

McGee is suing for past and future mental anguish, impairment and medical expenses.

He is represented by attorney Matthew Shaffer of the Schechter, McElwee, Shaffer & Harris law firm, based in Houston.

Judge Milton Shuffield of the 136th Judicial District has been assigned to the case.
