Couple claims 'new' car was used, files DTPA suit against local Dodge dealer

Thinking they were buying a new Dodge, Leroy and Easter Feat claim they soon found out they were actually sold a used car.

On Oct. 10 the Feats filed a Deceptive Trade Practices Act lawsuit against Mike Young Chevrolet in Jefferson County District Court, alleging the dealership lied to them and sold them a used car as new.

Court documents show that on Aug. 4 the couple purchased a 2008 Dodge Nitro SXT from Mike Young.

"Plaintiffs purchased this 'new' vehicle for a total sales price, including their down payment and finance charges, of $25,412.84," the suit says.

"Upon attempting to register their satellite radio, plaintiffs discovered that despite defendant's representations, the vehicle had been previously owned and was in fact purchased in 2007. Further, plaintiffs have discovered mechanical problems with the vehicle since its purchase."

The suit continues by alleging the dealership has refused to correct the errors or to honor the agreement.

The Feats are suing for actual and consequential damages, plus mental anguish and attorney's fees.

They are represented by Provost Umphrey attorney James Payne.

The case has been assigned to Judge Bob Wortham of the 58th Judicial District.
