Dishwasher claims termination result of worker's comp

ORANGE -- An Orange County woman has filed suit against her former employer, Flying J Inc., claiming she was fired for applying for worker's compensation benefits after she slipped and fell while washing dishes.

Avis Carpenter filed her suit Sept. 9 in Orange County District Court.

According to her suit, Carpenter began working at the Flying J in Orange in February 2007 as a multitask worker. In July 2007, she slipped while washing dishes.

"On account of her injuries � plaintiff applied for worker's comp benefits � and soon returned to work with � limited job duties," the suit says.

"In October 2007 plaintiff's employment was terminated by her supervisor � without reason. Plaintiff believes her termination to be on account of her having applied for and receiving worker's comp."

Carpenter is suing for actual and consequential damages, plus all court costs.

She is represented by John Morgan of the Lindsay & Morgan law firm.

The case has been assigned to Judge Dennis Powell of the 163rd Judicial District.
