Couple sues 25 companies for man's asbestos exposure

A Jefferson County couple has filed an asbestos suit against 25 defendant corporations, claiming the asbestos-related disease with which the man was diagnosed was wrongfully caused.
Michael and Shirley Osborne say Michael worked as a laborer, pipefitter, welder, rigger and laboratory technician, according to a lawsuit filed Dec. 16, 2008, in Jefferson County District Court.
Defendant companies include A.O. Smith Corp., A.W. Chesterton Co., Bayer Cropscience, Westinghouse, Certaineed Corp., Fluor Maintenance, Foster Wheeler, GE, Ingersoll Rand, 3M, Owens Illinois, Union Carbide, Uniroyal Goodrich Tire Co. and Washington Group International.
The Osbornes state the companies were negligent by failing to warn of the dangers of asbestos exposure and by failing to adequately test their products to determine the hazards associated with them, according to the lawsuit.
Because of Michael's disease, the couple claims they have suffered physical pain, mental anguish, lost wages, loss of earning capacity, disfigurement and physical impairment and incurred medical expenses.
The Osbornes seek unspecified exemplary and actual damages, plus pre- and post-judgment interest, costs and other relief to which they may be entitled.
They are represented by Bryan O. Blevins Jr. and Aaryn K. Giblin of Provost and Umphrey in Beaumont.
The case has been assigned to Judge Gary Sanderson of the 60th District Court.
