Local man sues UP after heavy lifting

A Hardin County man claims he received back injuries while working for Union Pacific Railroad Company.

Bruce Bynum claims he was working for the railroad on Jan. 14 when he received the injuries after attempting to lift an 80-pound knuckle.

"The injury to the Plaintiff was due in whole or in part to the negligence of the Defendant, its agents, servants, employees, officers and/or representatives, other than Plaintiff, acting in the course and scope of their employment," the suit filed March 19 in Jefferson County District Court states.

Because of the incident, Bynum claims he experienced past and future mental anguish and physical pain, past and future lost earning and benefits and past and future physical impairment.

He also incurred medical expenses and experienced disfigurement, according to the complaint.

Bynum is seeking punitive and exemplary damages, plus post-judgment interest at the legal rate, costs and other relief the court deems just.

He is represented by David P. Wilson and Matthew C. Matheny of Provost and Umphrey Law Firm in Beaumont.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
