Man has fingers crushed by forklift, sues Adobe Equipment

After losing four fingers when a forklift chain crushed his hands, Mark A. Davis has filed suit against the company who rented the machine.

The suit was filed against Adobe Equipment Houston on May 13 in Jefferson County District Court.

Court papers show that on Jan. 29 Davis, a Parker Lumber employee, was working in Port Bolivar. He was operating a Caterpillar forklift moving wire mats when the machine's chain became dislodged.

"Upon attempting to place the chain back into place, the forks suddenly moved and plaintiff's hands were caught up in the chains," the suit states. "As a result, plaintiff lost all four fingers on his right hand and injured his left hand."

The suit does not state if Davis neglected to turn off the engine before attempting to service the forklift.

In his suit, Davis alleges Adobe Equipment negligently failed to properly service the forklift, install chain guards and adequately train him.

He is suing for past and future mental anguish, medical expenses, pain and lost earnings, plus all court costs.

Davis is represented in part by attorney Dan Ducote of the Moore Landrey law firm.

The case has been assigned to Judge Donald Floyd, 172nd Judicial District.
