Feud over fence leads to Orange County suit

Orange Navy, a home building business operating out of the city of Orange, has filed suit against its neighbor, alleging Henry O'Neal refuses to relocate a fence.

The suit was filed Aug. 12 in Orange County District Court.

According to Orange Navy's petition, O'Neal "wrongly" placed a fence on its property, "taking approximately 5 feet of land owned by plaintiff."

"Defendant has failed and refused ... to remove the fence and place it on the correct property line, despite requests made by plaintiff," the suit states.

"Plaintiff requests that the court order Defendant to remove the fence and relocate it on the correct property line."

Orange Navy says in its suit that it is developing the area for new houses and the fence issue needs to be resolved before it can begin construction.

"Defendant's refusal to move the fence to the correct property line is impeding the construction of the new houses," the suit states.

In addition to the court order, Orange Navy is suing for attorney's fees.

The company is represented by the Law Offices of Tommy Gunn.

Judge Dennis Powell, 163rd Judicial District, has been assigned to the case.
