Plumber sues to recover payment for services

GALVESTON - A plumber seeks to recover approximately $5,500 in unpaid services and materials from a residential home builder.

Theodore L. Nolan Jr., doing business as Sonny's Plumbing, alleges Brentwood Homes has refused and failed to tender payment for the improvements done last year to the Northfield and Mary's Creek properties.

The suit was filed April 19 in Galveston County Court No. 2. Agent Brian K. Seiler is named a co-defendant in the case.

Nolan says he is owed $5,202.87 for work on Northfield and $350 for Mary's Creek.

Consequently, he filed liens on the properties on Jan. 28.

The defendants have misapplied the funds and have continually failed and refused to apply those funds to pay the plaintiff for the services and materials provided, the suit says.

Houston attorneys Isaac Villareal and Gregory P. Crinion are representing Nolan.

The case has been assigned to Galveston County Court No. 2 Judge C.G. "Trey" Dibrell III.
