Messed up Maserati leads to lawsuit

Two Beaumont brothers have filed suit against Maserati North America Inc. and a Houston car dealership, alleging the companies failed to fix the peeling leather interior of a Granturismo.

Elias and Imad Sarkis claim they began experiencing problems with their 2009 Maserati Granturismo shortly after they purchased it from Symbol Cars Inc., a Maserati and Ferrari dealer in Houston, on May 27, 2009.

"Immediately after the car was delivered to the Sarkis home in Beaumont, Jefferson County, Texas, Plaintiffs noticed that the leather interior was peeling away from the inside of the car," the suit filed Sept. 30 in Jefferson County District Court states.

In July, the Sarki brothers returned the car to Symbol for repairs, but received it back with no significant repairs performed, according to the complaint.

By October 2009, the Sarki brothers had involved Maserati in talks between them and Symbol, the complaint says.

With their car continuing to deteriorate, the Sarki brothers allowed Symbol to take possession of their vehicle in November 2009 for repairs, the suit states.

Yet again, however, the Sarkis claim they received their car back without repairs, but there was evidence that mechanics had worked on it as dirt and grease were smeared on the car's interior, the complaint says.

"Representations by Maserati that proper replacement parts were ordered and would be installed, that the car would be repaired, that the warranty would be honored, and that repairs would be promptly and properly effected all proved to be false," the suit states.

In their complaint, the Sarkis are seeking actual, punitive and exemplary damages, plus attorney's fes, pre- and post-judgment interest, costs and other relief the court deems just.

Dana Timaeus of Timeaeus and Rose in Beaumont will be representing them.

The case has been assigned to Judge Bob Wortham, 58th District Court.
