SHERMAN-A former debt collector is suing his employer for not paying his overtime wages.
Anthony Atkins, individually and on behalf of others similarly-situated, filed suit against CreditAnswers on Oct. 12 in the Eastern District of Texas, Sherman Division.
CreditAnswers is a Texas-based debt settlement company. Atkins was employed with the defendant as a debt consultant from December 2007 through March. He states that during his employment, he routinely worked more than 40 hours per week but was not paid at a rate of at least time and a half for hours in excess of 40 per week.
Further, Atkins argues that neither he nor any other debt consultants had job duties that would make them exempt under the Fair Labor Standards Act.
The defendant is accused of willfully violating the FLSA with regard to Atkins and other debt consultants.
On behalf of the proposed class, the plaintiff is seeking an award of unpaid overtime, liquidated damages, attorneys' fees and costs.
Atkins is represented by Robert J. Wood, Jr. and Gregory B. Fell of Fell & Wood in Richardson, Texas. Jury trial is requested.
U.S. District Judge Michael H. Schneider is assigned to the case.
