Texas City man sues woman who falsely accused him of assault

GALVESTON � A Texas City man has filed a lawsuit against the woman he claims made false accusations against him which led to his arrest.

Bert McWilliams filed suit March 9 in Galveston County Court at Law No. 3 against Tonya J. Moore. He alleges Moore intentionally and falsely reported to the Texas City Police Department that she was assaulted by McWilliams on Feb. 15, 2008.

"The statements made by the defendant that the plaintiff had threatened and assaulted her were false and the defendant knew such statements at the time she made such statements to the officers of the Texas City Police Department," the original petition says.

"Since such false statements falsely allege that the plaintiff committed a criminal offense such statements constitute slander per se."

The reportedly dubious charges remained pending until they were formally dismissed by the Galveston County District Attorney's Office in March 2009.

McWilliams also mentions that Moore committed fraud "by intentionally not disclosing to the plaintiff the existence of funds acquired during their marriage that she had secretly placed into an account in her name at ACU of Texas" despite a formal request for such information made during divorce proceedings between the two parties.

The plaintiff consequently seeks unspecified monetary damages and a jury trial.

He is represented by attorney Jack D. Ewing of League City.

Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
