Woman claims faulty walkway caused fall onto barge

A Beaumont woman has filed suit against her former employer who she claims allowed a gateway to fall, causing her to plunge into water.

Ariel Gutierrez claims she was working at defendant Oil Tanking Beaumont Partners on May 28, 2009. The defendant had installed the deck and a barge to allow access to the barge.

"When the Plaintiff walked onto the gateway, the gateway fell and the Plaintiff fell into the water below," the suit filed May 27 in Jefferson County District Court states. "The Plaintiff hit both the deck and the barge on the way down to the water and was severely injured."

Because of her fall, Gutierrez incurred medical costs, experienced pain and suffering and sustained physical impairment, according to the complaint. In addition, she lost earnings and her earning capacity and sustained mental anguish, the complaint says.

In her complaint, Gutierrez seeks a judgment within the limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, costs and other relief the court deems just.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
