Terminated nurse says management complained of cost of pregnant employees

SHERMAN - A nursing home is being sued for gender discrimination for firing a nursing supervisor the day after she announced she was pregnant.

Seneada Dailey filed suit against Millennial Care Management Inc. and Prestonwood Rehabilitation & Nursing Center Inc. on Nov. 18 in the Eastern District of Texas, Sherman Division.

Millennial owns and operates two nursing home and rehabilitation facilities in
Texas. One facility is located in Denton and the other location is Prestonwood, which operates in Plano.

Millennial issues paychecks to the Denton and Prestonwood management-level
employees. The management-level employees work full-time either at the Denton or
Prestonwood location and supervise the Denton or Prestonwood location employees.

Dailey was hired by Millennial in June 2007 as Director of Nurses at the Denton facility. In January 2010, she was promoted to the Director of Nurses at Prestonwood. The suit states she was responsible for supervising around 100 nurses.

According to the complaint, shortly after her promotion, Dailey learned that she was pregnant. Dailey states she told her supervisor about her pregnancy on Feb. 11, 2010. The suit says she was terminated the next day.

Dailey was told she was terminated for not handling a patient situation properly.

The defendants are accused of committing gender discrimination in violation of Dailey's civil rights.

In addition, Dailey claims Millennial/Prestonwood's owners and managers often complained that employees' babies unnecessarily increased Millennial/Prestonwood's
insurance premiums.

"Michelle Cudd, a part owner and Millennial/Prestonwood's Human Resources Director, commented that Millennial's insurance bills were too high and that employees 'don't need to be having babies.'" the suit states. "Cudd mentioned that Millennial's premiums
increased because an employee's premature baby required extensive hospital care."

The plaintiff is seeking damages for front pay, back pay, compensatory damages, exemplary damages, interest, attorney's fees and court costs.

A jury trial is requested.
