GALVESTON - Houston resident Melanie Szabo claims she was struck by a drunk driver in Galveston last July, recent court documents say.
According to a lawsuit filed Dec. 6 in Galveston County Court at Law No. 2, Konnie Schutz, also of Houston, was "heavily intoxicated" when she collided her 2008 Honda with Szabo's 2005 Toyota Camry the night of July 9.
The two-vehicle accident in question occurred around 10:25 p.m. when the defendant, driving northbound on 45th Street, ran a red light and hit the front driver's side of the Camry, the suit says.
A police officer summoned to the scene found Schutz to be under the influence of alcohol and "completely at fault for the wreck."
She was taken into custody and charged with driving while intoxicated.
The suit shows "this is the second time in two years Ms. Schutz has been arrested for driving while intoxicated."
Szabo says the wreck totaled her vehicle and inflicted injuries to her neck, back and shoulder.
Schutz is ultimately faulted for not keeping a proper lookout and gross negligence.
"She was aware of her intoxicated state and chose to drive," the complaint says.
Consequently, the plaintiff seeks no more than $150,000 in damages.
Attorney Brad T. Wyly of Houston is representing Szabo, and Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
