JPMorgan Chase Bank has filed suit against the company that borrowed money from it and the person who guaranteed a note, alleging it is owed more than $35,000.
JPMorgan alleges it lent defendant CMC Contractors a promissory note worth no more than $50,000 on July 17, 2006. Defendant Christine McDaniel guaranteed the note, promising to repay any money if CMC defaulted, according to the complaint filed June 6 in Jefferson County District Court.
Since then, however, CMC has stopped making payments and owes JPMorgan $35,856.04, the suit states. McDaniel has also failed to repay the money, the complaint says.
In addition to the money it says it is owed, JPMorgan is seeking a foreclosure on the property that CMC used to secure the loan, attorney's fees, costs, post-judgment interest at the highest rate allowed by law and other relief the court deems just.
