Jefferson County residents file lawsuit claiming Nintendo controller caused house fire

A Jefferson County couple has filed a lawsuit that claims their Nintendo Wii controller started a fire that caused significant property damage.

Paul Bernard and Vanessa Bernard filed suit against Griffin International Companies Inc., Nintendo of America Inc. and Nintendo Co. Ltd. on May 10 in Jefferson County Court. The defendants removed the case to the Eastern District of Texas, Beaumont Division.

According to the lawsuit, a fire started at the plaintiffs' home in Jefferson County on July 16, 2010, allegedly caused by a Wii controller. The fire caused significant damage to real property and personal property.

The defendants are accused of negligence in the design, manufacturer and marketing of the Wii controller. Further, the defendants are accused of breaching one or more warranties and for violating the Texas Deceptive Trade Practices-Consumer Protection Act.

The plaintiffs are asking the court for an award of damages to their real property, personal property, out-of-pocket expenses, mental anguish, interest, court costs and attorney's fees.

Bernard is represented by Curtis W. Leister of Reaud, Morgan & Quinn LLP in Beaumont.

U.S. District Judge Ron Clark is assigned to the case.
