GALVESTON - Harris County resident Santos M. Hernandez has filed suit against Miken Specialties Ltd. and Miken GP LLC over facial injuries he received while working at a Texas City plant.
A lawsuit filed July 10 in Galveston County District Court claims the injury occurred at the BP refinery on July 2, 2010, when an unidentified Miken employee dropped a tape measure on Hernandez.
According to the suit, the plaintiff was working on the ground near a scaffold built and operated by Miken at the time of the event.
"He suffered injuries to his face, including a fractured nose and knocked out teeth," the original petition says.
"The plaintiff began to bleed profusely."
As co-workers came to Hernandez's aid, the suit claims co-workers saw the man who injured him attempting to run down some scaffolding.
The unnamed worker is also a defendant in the case.

Consequently, the complainant seeks unspecified monetary damages and a jury trial.
He is represented by attorney Mark W. Collmer with Collmer Law Group in Houston.
The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
