Harris County Attorney Menefee supports EPA’s ‘Good Neighbor Plan’ in amicus filing

HOUSTON - Together with a coalition of states, Harris County Attorney Christian D. Menefee filed an amicus brief in the 5th Circuit Court of Appeals supporting the Environmental Protection Agency’s “Good Neighbor Plan.” 

The EPA’s “Good Neighbor Plan” is a rule that expands on an existing multistate framework for limiting interstate ozone pollution under the Clean Air Act. The plan includes requirements for twenty-three states to reduce their smog-forming emissions that travel into fourteen downwind states.

“We’re working collaboratively with other states to address the adverse impacts of pollution and supporting the EPA’s ‘Good Neighbor Plan,’ once again showing that Harris County is a leader in fighting for the health and well-being of the people who live here,” said Menefee. 

“Everyone deserves to breathe clean air, and we believe the EPA’s new plan is a significant step in improving air quality and public health. This plan not only helps reduce emission impacts in other states, but also reduces the impact of emissions from other states on Harris County.”

The amicus brief sides with the EPA in opposition to the motions filed by Texas and Mississippi. The legal action is part of ongoing efforts by Texas, Mississippi, and fossil fuel industry groups to contest the implementation of the “Good Neighbor Plan.”
