Harris County sues HEB over off-duty peace officer’s death

HOUSTON - Harris County has filed suit against HEB Grocery, seeking indemnity benefits paid on behalf of a peace officer who was fatally injured while off duty and taking action when a criminal act occurred.

The lawsuit was filed April 1 in Harris County District Court. 

According to the lawsuit, on March 31, 2022, Harris County’s employee, a certified peace officer, was off duty and at an HEB owned store. The officer observed a criminal act taking place and had a duty to act. As a result, the officer suffered fatal injuries. 

The suit asserts HEB had a legal duty to maintain the premises and protect patrons from criminal acts.

“Defendants failed to provide adequate security measures to all persons on its premises,” the suit states. “Defendants breached their duty and such breach was the proximate cause of the occurrence.” 

Harris County Attorney Christian Menefee represents the county.
