On April 12, 2024, Andy Ybarbo filed a lawsuit against Integrated Works, LLC and National Drayage Services, LLC in the District Court of Harris County, Texas. The case number is 2024-23556 and it was filed under Court 295. The plaintiff alleges negligence on the part of the defendants leading to severe bodily injuries.

The incident at the center of this case occurred on February 7 at the Red Bluff Yard in Pasadena, Texas, operated by National Drayage Services. Ybarbo was performing his duties under staffing agency Integrated Works when he fell from a ladder resulting in multiple fractures to his spine. He attributes his fall to inadequate safety measures, training, and deviation from standard safety practices by the defendants.

Ybarbo is seeking monetary relief over $1 million for damages sustained due to the alleged negligence of Integrated Works and National Drayage Services. Both companies are non-subscribers to Workers’ Compensation and thus cannot assert common law defenses typically available to subscribers such as contributory negligence or assumption of risk.
