John Wesley Cherry sues Primoris Services Corporation for accident at construction site

In a lawsuit filed on April 17, 2024, in the District Court of Harris County, Texas (Case No. 2024-24795), plaintiff John Wesley Cherry has sued Primoris Services Corporation and James Construction Group, LLC. The case is about an accident that occurred at a construction site operated by the defendants.

The plaintiff, a resident of Bell County, Texas, was working for Blackhawk Transport when the incident happened on July 17, 2023. His task was to deliver a load of rebar to a construction site off State Highway 95 in Holland, Texas. While taking inventory of the rebar as instructed by the project foreman—an employee of either James Construction or Primoris—a front-end loader driven by another employee began unloading the rebar before Cherry could move out of the danger zone.

Cherry's attorney argues that this action resulted in damages to his client. The lawsuit claims that both defendant companies are responsible because their officers, agents, servants, employees or representatives committed this act within their employment scope and duties.

Cherry is seeking over $1 million in damages under Rule 47 of the Texas Rules of Civil Procedure. He asserts that he did nothing to contribute to this occurrence and has satisfied all conditions precedent to bringing this lawsuit.
