Samuel Pennington sues Darwin Jose Valle Escalante for negligence resulting in a car accident

Samuel Pennington has filed a lawsuit against Darwin Jose Valle Escalante in the Harris County Civil Court at Law No. 3, under the case ID 1770489, dated April 18, 2024. The plaintiff alleges that due to the defendant's negligence, he suffered serious injuries in a car accident.

Pennington, represented by Armstrong Lee & Baker LLP, claims that on August 24, 2023, while traveling on Interstate 10, Escalante rammed into his vehicle from behind causing substantial damages. The plaintiff is seeking monetary relief of $250,000 or less for damages including penalties, costs, expenses and attorney’s fees.

Escalante's alleged negligence includes failing to control speed and maintain a safe distance among other violations. Pennington incurred medical expenses for treatment of injuries to his neck and back caused by the collision and anticipates future medical expenses as well.

The plaintiff demands a trial by jury and seeks judgment awarding him actual damages and additional damages as allowed by law, costs of court, pre- and post-judgment interest to the maximum extent as allowed by law.
