Xavion Culclager sues Union Pacific Railroad Company for personal injuries due to alleged negligence

In a case filed on April 19, 2024, in the District Court of Harris County, Texas (case ID: 2024-25254), plaintiff Xavion Culclager is suing Union Pacific Railroad Company. The lawsuit alleges negligence under the Federal Employers’ Liability Act (FELA) resulting in personal injuries.

Culclager, a resident of Texas and former conductor for Union Pacific, claims that while working in Fowler, Kansas on July 27, 2023, he was exposed to toxic fumes from hazardous chemicals. The exposure led to severe health issues including permanent damage to his vision.

The lawsuit further states that due to Union Pacific's negligence, Culclager suffered physical pain and suffering, mental anguish, lost earnings and benefits, loss of future wage-earning capacity, physical impairment or disability, medical expenses and loss of enjoyment of life.

Culclager is seeking damages for the aforementioned issues as well as a judgment against Union Pacific for their alleged negligence under FELA.
