Luis Angel Rivera sues Agustin Briones Hernandez for negligence causing personal injuries

In a lawsuit filed on April 19, 2024, in the District Court of Harris County, Texas (Case ID: 2024-25500), plaintiff Luis Angel Rivera is suing defendants Agustin Briones Hernandez and Gabriel Horta Orellana. The suit alleges negligence, negligence per se, and gross negligence causing substantial personal injuries to Rivera.

The case details that on November 16, 2023, Rivera was traveling southbound in Harris County when Hernandez failed to yield the right of way while turning left and crashed into Rivera's vehicle. This caused Rivera's vehicle to veer into a ditch and sustain damage to its front portion. As a result of the impact, Rivera sustained serious injuries requiring medical treatment.

The plaintiff accuses Hernandez of various negligent acts including failure to control his vehicle, maintain a proper lookout or an adequate distance from other vehicles, adhere to traffic markings or signals on the road, and violating multiple sections of the Texas Transportation Code. The plaintiff also alleges that Orellana negligently entrusted his vehicle to Hernandez knowing he was unfit or likely to operate the vehicle in a manner posing an unreasonable risk of harm.

Rivera is seeking monetary relief of $250,000 excluding interest, statutory or punitive damages and penalties, attorney’s fees and costs under Level I of Texas Rules of Civil Procedure 190 due to this suit involving only monetary relief.
