Yolin Solis sues City of Houston for personal injuries sustained in an accident due to alleged negligence

In a lawsuit filed in the Harris County - County Civil Court at Law No. 4, plaintiffs Yolin Solis and Nelson Cruz are suing the City of Houston, Kevin Dewayne Felder, and Herc Rentals Inc. The case, identified as CAUSE No. 77"°°, was filed on March 25, 2024.

The plaintiffs allege that they were injured in an accident in Harris County, Texas on March 28, 2022 due to the negligence of the defendants. Kevin Dewayne Felder, an employee of the City of Houston and operating a vehicle owned by Herc Rentals Inc., is said to have reversed unsafely into the plaintiffs' vehicle while towing a trailer owned by the City of Houston.

According to the filing, this incident resulted in personal injuries for both Solis and Cruz. The suit claims that Felder failed to maintain proper lookout or control speed among other violations leading to the accident.

The plaintiffs are seeking damages for their personal injuries sustained from this accident under Texas Tort Claims Act. They assert that their injuries were solely and proximately caused by Felder's negligent acts while he was acting within his scope of employment with the City of Houston.
